1. PREAMBLE

We welcome you to Pwiic.com! PWIIC offers intermediary services for the online linking of users in search of services, objects, carpooling, exchange, news or good plans via the website pwiic.com and its derivatives. Our site wants to be a place where people can meet and in the best conditions. Our Members share their identity and / or personal data, communicate with other Members, send or receive messages, and find opportunities. We are confident that our Service enables our Members to meet effectively and base our strategy on a rigorous data ethic.

  • The purpose of this Privacy Policy (hereinafter the "Pp") is to define the rules applicable to the data that we collect, design, use, save through our Site, as well as the choices you have regarding the collection, use and disclosure of this data. This PP is a supplement to our General Terms of Service (GTS). Concerning the terminology used in this PP, please refer to the GTS article 3 Definitions.
  • We protect your personal data in accordance with the legal provisions in force: GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data. personal character and the free movement of such data).
  • We may share your data with third parties where permitted or required by law.
  • We can modify this PP punctually. We invite you to regularly check this PP to keep up to date with the latest changes. If you object to any changes, you may close your Member Profile. You consent to changes to this PP by continuing to use the Site after the change.
  • Our PP applies regardless of the terminal to access the Site or its derivatives and our PP applies to any person who has a Member Profile on the Site, or any person who consults the Site.
  • By accessing and / or using the Site, you acknowledge that you have read, understood and agree to be subject to all the conditions provided for in this document. If you do not agree with this PP or with us, you must not use the Site and its Linked Services and you must not give us your personal data.

 

GENERAL DATA MANAGEMENT POLICY

 

PWIIC has made privacy a priority. Our strategy of differentiation is based on a rigorous data ethic in order to collect, store, use and safeguard your personal data according to the principle of data minimization. ie to limit the collection of personal data to what is strictly necessary for the Service we offer. The principle of minimizing data can be found in the GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free circulation of these data).

We also apply a privacy by design policy. The principle is to take into account the protection of personal data and the minimization of data as soon as possible when designing new Services that we offer. Before developing a new feature on the Site, we always start by asking ourselves the question: "What personal data do we really need to provide our Service", in order not to get more data than necessary. We are fighting against the principle of big data and can provide a more secure site.

Some data may be retained to improve the Service we provide through data analysis. We apply in this case, where possible, an anonymization of the data. We can then keep the data and analyse it without being associated with a particular person.

And finally, the European regulation on the protection of personal data (Article 30 of the GDPR) recalls the obligation to keep a record of data processing, complete and updated. This obligation applies only to companies or administrations of 250 employees or more. PWIIC is not legally obliged to keep this record given the size of the Company. Nevertheless, in order to continually improve our data management, we decided to go through the exercise. Held by the data protection officer (DPO) of PWIIC, this register mentions the name and contact details of the controller, the purposes of the processing, the categories of data subjects (customers, employees, candidates), the internal or external stakeholders, management of these data, the flow of data flows, the deadlines for erasing data, and a description of the technical and organizational security measures taken to ensure their protection. Our data processing register is maintained according to the registry model proposed by CNIL (France).

 

ACCEPTANCE OF THIS PP

As we have already explained, and as you will see later, we make the choice to limit the collection of personal data to what is strictly necessary for the Service we offer. Some of this data is essential to access the Service, in its minimal functionality. They must therefore be communicated to us compulsorily. Others are optional, but they optimize your use of the Service. However, it is you who decide whether you communicate them or not, and you can withdraw them yourself at any time.

In view of the foregoing, the overall acceptance of our CVP is required to use our Service and that is why we state that if you do not agree with this CVP, you must not use the Site and its contents. Related Services and you do not have to provide us with your personal data.

 

2. COLLECTION AND USE OF PERSONAL DATA

In general, you can browse the Site without identifying yourself or providing any personal data.

 

By registering on the Site, we may collect and process certain personal data. This is particularly the case when you fill out forms (such as the registration form), when you participate in one of our studies or surveys, when you contact us - whether by phone, email or any other means of communication - or when you tell us about a problem or have a question about the functioning of the Site. It is either personal data that you transmit to us (provide) directly (2.1) or data that we automatically collect (2.2).

 

2.1. The information you transmit to us (provide) directly.

The data you provide can be seen by others. These are certain elements of your Member Profile, such as your photo, your description, your Skills, your public pages, your public comments, etc. Your public pages can be indexed on search engines such as, for example, Google. Do not fill in the optional data fields if you do not want these data to be visible, processed or stored by us. Do not add Skills if you do not want a public page created for your Skills.

 

These data are of two types: 

  • Or Mandatory (2.1.1 Mandatory Data in order to provide you the Service): The personal data requested during the registration are all obligatory, because all necessary for the Service that we propose.

 

The data necessary for registration to the Service that we provide on the Site or access to any other service provided by Us, are therefore mandatory. This Mandatory Data includes your surname and first name, e-mail address, postal address, sex, pseudo (which will define the url of your personal page on the Site) and password. This information is Mandatory, otherwise, Pwiic will not be able to provide you with the Services offered by our Site and you will not be allowed to create a Member Profile on our Site; 

  • Or Optional (2.1.2 to 2.1.12 Optional Data to improve the Service): The other data you transmit to us are all Optional Data. You can manage them in your Member Profile. The optional data entered in your Member Profile are only the ones you decide to provide us. 

 

2.1.2. One or more photographs

 

2.1.3. A phone number ;

 

2.1.4. Information relating to the advertisements (= to the Pwiics) that you publish on the Site;

 

2.1.5. A description of your Skills (if you offer services on the Site);

 

2.1.6. A copy of all exchanges between you and Pwiic or between you and other Members through the Site;

 

2.1.7. The data we may ask you to provide when you report a problem with our Site or Services, such as the subject of your request for assistance;

 

2.1.8. Your answers to our surveys and questionnaires and the opinions you have left to evaluate another member of our community, or to evaluate the Site, this information being particularly likely to be used for research and analysis of behavior user;

 

2.1.9. A copy of all publications made on the Site and including the comments of other Members and evaluations: The other Members of the Site have the possibility to post comments on the quality of the services you offer if you are a Service Provider or the quality of the relationship between Members. These comments are visible to other Members and visitors. You can still report an unwanted comment by sending an email to [email protected];

 

2.1.10. The details of the missions carried out on the Site in order to provide you with an annual statement of the services performed within the scope of the declaration of your income;

 

2.1.11. Financial or accounting transactions carried out on our Site or by any other means, including information relating to your payment card, your bank details which are stored securely at our online payment partner (STRIPE);

2.1.12. A copy of your passport or identity card, or any other similar document that you have agreed to provide to us. As part of our policy to detect fake Member Profiles, the Company may ask you to provide proof of your identity (eg copy of your identity card, copy of a recent invoice, extract from bank-crossroads of companies, etc.). Documents that you provide in this framework or as part of a Member Profile certification application to obtain a "Verified Identity" badge, are not visible on the Site and are only used for Profile verification purposes ;

 

2.2. The data we collect automatically

2.2.1. The data related to your language preference, so that you can consult the Site in the language of your browser.

 

2.2.2 Data related to your location when you have agreed that we collect and process this data;

 

2.2.3 During each of your visits to the Site, we may collect, in accordance with the applicable legislation and with your agreement, if necessary, information about the devices on which you use our services or the networks from which you access our services, such as your IP addresses, login details, types and versions of Internet browsers used, types and versions of your browser plugins, operating systems and platforms, data concerning your navigation path on the Site, including your journey on the various pages of our Site URL, the content you access or view, the search terms used, download errors, the duration of viewing certain pages, the advertising ID of your device, interactions with the page as well as any phone number used to contact us. Among the technologies used to collect this information, we use cookies (to find out more about this, please refer to our Cookies Policy). 

 

2.2.4. We also collect information about your use of our Site (such as the number of Pwiic posts, your response rate to messages and Pwiics from other Members, your registration date, your last login date, your average received, etc.) that may be displayed on your Public Member Profile.

 

3. DURATION OF DATA CONSERVATION

 

3.1. With the exception of the categories of Personal Data referred to in Articles 3.2. and 3.3. below, your Personal Data is archived at the end of the following periods:

  • 3 years after your last use of the Site, if you have not closed your Member Profile;
  • 1 year after the closure of your Member Profile, unless you have received a report, in which case your data are kept for 2 years after the last report received if this duration is longer, as part of our policy of detection of fraud. After the closure of your Member Profile, the data is immediately anonymised on the Site.

3.2. The following categories of Personal Data may be retained for different durations:

  • Financial data (eg payments, refunds, etc.) are kept for the period required by applicable tax and accounting laws;
  • The content created by you on the Site (such as Pwiics, comments to Pwiics, notice and rating) are made anonymous past the deadlines mentioned in 3.1 but remain visible on the Site.

 

3.3. If your Member Profile has been deactivated by Us, we keep your data for a period ranging from 2 to 10 years from the suspension in order to avoid any circumvention by you of the rules in effect on our Site. 

 

4. DATA FINALITY

How do we use the data we collect? We use the data we collect in order to:

4.1. Execute contracts between you and us or between you and one of the other Members and provide the requested information and services.

4.2. You send information about our Services by e-mail, SMS or any other means of communication, for example to:

  • Confirm that a Pwiic or an Offer has been published or sent.
  • Transmit information that a new Pwiic might interest you.
  • Transmit information that another Member has left you a message or left a comment on a Pwiic for which you have shown interest.
  • Transmit the requests to the Service Providers, communicate the Service Providers quotes, communicate the contact details of the Service Applicants to the Service Providers.
  • Transmit the Offers to the Service Applicants, communicate the contact details of the Service Providers to the Service Applicants.
  • Deal with any complaints.
  • View Member profiles in search results or news feeds of other Members.
  • Manage the consumption of Credits (Pwiic Coins).
  • Manage the payment of invoices. 

4.3. Collect your payments or send you the sums collected for your Member Profile.

4.4. Allow you to customize your Member Profile on our Site.

4.5. Allow you to communicate and interact with other Members of our community, including our Services or the Pwiic (s) sent.

4.6. Give you access and allow you to communicate with our customer service.

4.7. We ensure compliance with (i) the applicable law, (ii) our general conditions of use, (iii) our privacy policy and (iv) our charter of conduct.

4.8. You send a statement of the Services performed on the Site.

4.9. Inform you of changes to our services.

4.10. Check the information contained in your passport, identity card or any other document of identity that we would have collected during your registration or your use of our Site.

4.11. Manage our Site and perform internal technical operations for problem solving, data analysis, testing, research, analysis, studies and surveys.

4.12. Improve and optimize our Site, in particular to ensure that the display of our content is adapted to your device.

4.13. To help us preserve a secure environment on our Site.

 

5. RECIPIENTS OF DATA

Who are the recipients of the information we collect and why do we share this information with them?

In connection with the use of our Services, some of your information is passed on to other Members of our community who are authorized to post on our Site, through your Public Member Profile or as part of the response process. one of your Pwiics (for example we communicate your telephone number or email to people interested in your Pwiic and who wish to contact you directly to offer you a service or object or to solicit you directly if your Pwiic interest them).

5.2. We may also share information about you, including Personal Data, with other Pwiic Group entities as provided in this policy. We may disclose your personal data to our subsidiaries, our affiliates.

5.3. We are also likely to work closely with third-party companies that may have access to your Personal Data, including:

  • our business partners who promote their services on our Site and to which you may decide to subscribe. These services may include insurance services, banking services, etc.
  • our insurance partners or insurance intermediaries in order to confirm your eligibility for insurance programs, provide you with a price, allow you to subscribe to the proposed insurance policies and manage your claims where applicable and meet their legal and regulatory obligations ;
  • the subcontractors or trusted third parties we use for technical services, payment services, e-mail services or data centers (for the latter, exclusively for storage purposes), identity verification or analytical solution providers and collection companies and credit agencies.

We do not share your data with third parties mentioned in 5.3. above that:

  • when we use a service provider in the performance of any contract entered into between you and us or to provide or improve our Services (for example as part of payments made through the Site;
  • when we use search engine providers and analytics solutions to improve and optimize our Site;
  • when you subscribe to a service provided by one of our partners, ask for an offer or a good plan from one of our partners);
  • When we post, on the websites of our business partners, parts of our Site (including any Pwiics you have posted or the skills and items that you have added to your Member Profile) through APIs or widgets. In this case, some information from your Public Member Profile may also be posted on these sites;
  • We publish notices that you write as part of our notice system on our Site. These notices, which contain your Pseudo, locality, as well as your photograph are visible by all the visitors of the Site and the sites of the partners on which the opinions were shared;
  • Where we have a legal obligation to do so or if we believe in good faith that this is necessary to (i) respond to any claim against Pwiic, (ii) comply with any judicial request, (iii) enforce any contract with our members, such as the Terms of Use and this Privacy Policy (iv) in the event of an emergency involving public health or the physical integrity of a person, (v) in the context of investigations and investigations, or (vi) to guarantee the rights, property and safety of Pwiic, its members and more generally any third party;
  • If we sell or acquire a business or assets, in which case we reserve the right to share your Personal Data with the potential seller or buyer of the business or assets;
  • If Pwiic or all or part of its assets are bought back by a third party, the data in our possession will, if necessary, be transferred to the new owner. 

 

6. MODERATION OF MESSAGES, COMMENTS, NOTICES

How do we use and moderate your messages, comments or notices left on the Site?

6.1. We may read the messages that you exchange with other Members of our community via our Site including fraud prevention, improvement of our Services, user assistance, verification of our members' compliance with contracts concluded with us and in particular our Terms of Use. For example, to prevent a member from bypassing our Credits system, to communicate information in inappropriate areas (for example, to communicate his email or phone in the Public Comments boxes), we are allowed to browse and analyze the messages. exchanged on our Site to ensure that they do not contain any contact information or references to other websites.

6.2. We never see your communications with other members of our community for promotional purposes or advertising targeting. Whenever possible, we use automated systems to moderate messages sent between members via our site (for example, an email or phone detected, and communicated in the public comment areas, will be automatically deleted by the system ). You can freely exchange your details in the private chat messaging.

 

7. NEWSLETTER AND MESSAGES RELATING TO PWIICS

When you add one or more Skills to your Member Profile, you will receive an email or sms each time a new Pwiic matches your Skills. Our intelligent robot (PwiicBot) locates the Pwiic and sends it to the Members according to the Skills and distance added in the Skills. If you do not want to receive these notifications, do not add skills to your profile, or you can add skills by disabling Skills notifications.

 

8. NEWSLETTER AND INFORMATION MESSAGES

In accordance with applicable law and with your consent when required, we may use the data you provide to us on our Site to send you our newsletters, send you invitations to our events or any other communication that may be of interest to you.

You may at any time withdraw your consent by (i) unchecking the box in your Member Profile, (ii) clicking on the unsubscribe link provided in each of our communications or (iii) contacting us as described in Article 16 below.

 

9. TRANSFER OF DATA

Is your data transferred, how and where?

We keep your Personal Data in the European Union. On simple request, we can provide you with the list of countries where we store your data and those where they pass occasionally. 

 

10. YOUR RIGHTS ON YOUR DATA

What are your rights on your personal data?

10.1 You have the right to obtain a copy of your personal data that we hold. Before responding to your request, we may (i) verify your identity and (ii) ask you to provide us with more information to respond to your request. We will endeavor to comply with your request within a reasonable time and, in any event, within the time limits set by law. If you wish to exercise this right, contact us in the manner indicated in article 16 below.

10.2 As a Member of our Site, you also have the option to access the Personal Data we hold through your Member Profile to rectify, modify or delete any incorrect information. You can also correct or delete this information by contacting us directly (see article 16 below). You can also close your Member Profile online at any time and have the right to oppose or limit the processing of your Personal Data.

10.3 Please note that we may retain certain information about you when required by law or when we have a legitimate reason to do so. This is the case, for example, if we believe that you have committed fraud or violated our Terms of Use and that we wish to prevent you from circumventing the rules applicable to our community.

10.4 You have the right to lodge a complaint with the competent supervisory authority or to obtain compensation from the competent courts if you consider that we have not respected your rights.

10.5 You also have the right to the portability of your data, that is to say the right to receive the Personal Data that you have provided us in a structured, commonly used and machine-readable format and the right to transmit these data to another controller.

You agree to keep this password secret and not to communicate it to anyone. You can change your password in your Member Profile or through the "Forgotten Password" feature.

Our Site may occasionally contain links to the websites of our partners or third parties. Please note that these websites have their own privacy policy and that we are not responsible for the use made by these sites of the information collected when you click on these links. We invite you to read the privacy policies of these sites before sending them your Personal Data.

 

14. SECURITY

The Company attaches the utmost importance to the security of your information. To this end, we have implemented security measures in line with industry standards, which include the use of encryption technologies and firewalls. However, no method of Internet transmission or electronic storage is 100% secure. Therefore, we can not guarantee its absolute security.

 

15. AMENDMENT OF OUR PRIVACY POLICY

We are constantly innovating to improve our Service so that it is dynamic and effective. This means that we can create new ways to collect and process data on the Service. We frequently launch new features and we can collect and process new types of data. Therefore, this PP may be modified.

When necessary, we will notify you and / or seek your agreement. We advise you to regularly check this page to be aware of any changes or updates to our privacy policy.
